What do the terms “divided” and “undivided” mean for new residential buildings?

Divided co-ownership corresponds to the "condo". The building is divided into "fractions". Each fraction includes:

  • a private portion (the apartment) which is the exclusive property of a co-owner and of which the latter has the exclusive use
  • a share (%) in the common portions which are the property of all the co-owners and which are used for their common use.

Co-ownership is undivided when several people hold the right of ownership to a building.

The classic example is that of a couple buying a home. Both spouses are co-owners of the building. The same is true when several people inherit a building. Each holds percentage shares of the building.
