Bond Amount

The bond is $40,000 for general contractors (subcategories of Schedule I) and $20,000 for specialized contractors (subcategories of Schedule II and III).

 

The Régie du bâtiment du Québec requires security, but does not issue it.

Types of admissible guarantees and documents to provide

Attention ! For now, the irrevocable and unconditional letter of credit issued by financial institutions (letter of guarantee from a bank) is not one of the forms accepted as security by the RBQ.

Legal persons authorized to stand surety:

Under the Bank Act (R.S.C., 1991, c. 46), the Act respecting financial services cooperatives (chapter C-67.3), the Act respecting trust companies and savings companies (R.S.Q. , c. S-29.01) or the Act respecting insurance (R.S.Q., c. A-32).

 

A bank, a savings or credit union or a savings company authorized to stand surety

Under the Bank Act (R.S.C., 1991, c. 46), the Act respecting financial services cooperatives (chapter C-67.3), the Act respecting trust companies and savings companies (R.S.Q. , c. S-29.01).

 

You must use the commitment form provided by the Régie (www.rbq.gouv.qc.ca/en/). All provisions contained in this form must be fully contained in that provided by the Surety (or the Contractor if acting as Surety).

 

Individual bond insurance policy issued in favor of the Régie du bâtiment du Québec (art. 28 1o)

 

Bond issued by:

 

  • a company holding a bond insurance license

  • another legal person authorized to stand surety (art. 29)

Collective suretyship insurance policy issued in favor of the Régie du bâtiment du Québec (art. 28 1o)

  • another legal person authorized to stand surety

Important note regarding this type of bond

 

Certified checks or drafts are deposited with the Ministry of Finance on a "deposit and consignment" basis. Even if the entrepreneur wishes to terminate his bond, the bond cannot be released for 5 years. If a civil action is filed within the time prescribed in section 37 and a final judgment is not rendered, the bond is not released.

GUARANTEE PLAN - ACCREDITATION

Unlike the bond, the certificate of accreditation to the guarantee plan does not have to be submitted when applying for a license. Notices informing you of the deadlines for providing proof of accreditation to a guarantee plan will be sent to you following your license application.

 

General contractor in new residential buildings: accreditation certificate

As an Entrepreneur, if you hold one or both sub-categories 1.1.1 and 1.1.2. you must join the Mandatory Guarantee Plan, and obtain an accreditation certificate from the RCMP (Residential Construction Guarantee).

 

In Quebec, if you want to sell or build a new residential building, you must meet the following two conditions:

 

  • Be accredited with the Residential Construction Guarantee.

  • Hold your Contractor's License from the Régie du bâtiment du Québec including at least one of subcategories 1.1.1 or 1.1.2

     

Forms to attach to your accreditation request

 

To be accredited for the Residential Construction Guarantee, you must complete the following documents:

 

  • Membership application, payment of $442.65 (including applicable taxes) covering the analysis fees and the other documents indicated in section 9 of the membership application. These fees are non-refundable.

  • Personal balance sheet form, along with related documents (e.g. municipal assessments of your properties, mortgage balances for buildings, your investment statements, etc.)

  • Year-end financial statements accompanied by a review engagement report prepared by a CPA or opening balance sheet accompanied by a review engagement report prepared by a CPA.

  • Membership agreement – Important note: Each page must be initialed at the bottom right for each of the signatories
